Yesterday Marcin Boruc signed a court settlement agreement in a case involving multimillion claims of our Client (a leading distributor of medical, laboratory and test equipment) against an unfair competitor managed by the Client’s former employee.
As a result of the effective actions taken by our lawyers (both in court and during negotiations), not only has the Client in fact satisfied a bulk of its claims for damages (and this even before the court settlement was signed) but, even more importantly, it managed to rebuild and develop its business relations broken by its existing partners as a result of the defendants’ actions (in particular, the Client has now again the status of a distributor of world-class equipment for hospitals and laboratories manufactured by companies based in Israel and the UK).
What gave an impetus that ultimately led to a quick and amicable resolution of this complicated dispute was that we succeeded in obtaining a number of final and non-appealable injunctions to effectively secure the Client’s claims on the defendant’s assets. Interestingly, in one of the “enforcement” proceedings for injunction (namely, in proceedings at the land and mortgage register court regarding registration of a joint judicial mortgage) it was necessary to seek the opinion of the Supreme Court, which granted our cassation appeal).
