Network aspects and connection aspects in the energy industry have long been among our key areas of expertise at Radzikowski, Szubielska i Wspólnicy. These are not simple matters, and they get more and more complex along with the fast and sweeping regulatory changes at national and EU level, which requires a high level of expertise from lawyers in order for them to be able to find good solutions so that their clients can go ahead with their investment projects.
From 2019, the connection process no longer ends with the signing of a grid connection agreement, but instead the burden has now shifted to the process of obtaining use permits (so-called operational notifications) under the procedure described in the NC RfG Network Code (Commission Regulation (EU) 2016/631 of 14 April 2016 establishing a network code for the connection of generators).
Therefore, we are happy to be able, as a law firm, to participate in landmark cases such as the one in which our Client was granted, for the first time in Poland, a derogation from the requirements of the NC RfG Network Code, which enabled a grid connection for one of the largest wind farms.
