Environmental regulations accompany our Clients in their investment processes and day-to-day operations. Given the EU’s climate and energy goals, it is necessary not only to ensure that activities undertaken comply with current regulations, but also to take into account the need to implement solutions that are in line with sustainable development, including ESG.

In our practice we support Clients both with projects that are still under development – in this respect we carry out due diligence processes in particular – and we provide assistance in obtaining administrative decisions and in operations compliance analysis for existing facilities. We also advise on the adoption of solutions to reduce greenhouse gas emissions (e.g. hydrogen, CCS and biomethane technologies).

In our practice we combine our knowledge and experience in the areas of substantive and procedural administrative law, compliance, civil law and criminal law.

Scope of services
  • environmental due diligence on production facilities and investment projects in a variety of sectors, including energy (conventional power plants, combined heat and power plants, heat plants, renewable energy installations)
  • advice on environmental issues in real estate sale agreements, project rights sale agreements and share purchase agreements
  • advice on implementing investment projects aimed to achieve greenhouse gas emission saving targets
  • advice on internal guidelines and policies with regard to legal compliance
  • advice in relation to environmental regulations in the operational activity of enterprises
  • representing clients in administrative procedures related to obtaining decisions with respect to environmental protection
Representative experience
  • conducted a due diligence on paper mill operations with regard to environmental regulations
  • conducted a due diligence on the operations of conventional power plants with regard to environmental regulations
  • advised on the impact of administrative decisions obtained for the construction of a wind farm, including decisions on environmental conditions, water permits and tree removal permits, on the planned acquisition of rights to the project by the investor
  • prepared comprehensive guides for investment in technologies being developed in relation to the goal of reducing greenhouse gas emissions – hydrogen, carbon capture and storage (CCS), biomethane
  • advised a Client active in the energy sector on the fulfilment of the energy efficiency obligation and meeting the National Reduction Target
  • advised a Client active in the energy sector on issues relating to reaching the National Indicative Target (biofuel quota)
  • drafted a Taxonomy-related agreement in connection with a planned change of technology at a plant in the energy sector
  • represented a Client in the negotiation of a sales agreement for a property subject to remediation obligations
  • supported an entity that planned an alteration of a weir on a river in the course of administrative procedures and in relations with other users of the water resources
  • supported a Client in proceedings to issue a decision on environmental conditions
  • verified compliance of procedures and documents applied by a Client operating in the energy sector with chemical market supervision regulations (including REACH, CLP, regulations concerning precursors of drugs and explosives and dual-use products)
